Noida Police books a builder for cheating, fraud with buyer for apartments in Haridwar

The police have booked the builder Gyan Chandra Yadav, the director of M/s Emerald Tourist Homes Pvt Ltd

The Noida Police booked a builder and his associates for cheating a person of Rs 9.35 lakhs conning him to get an apartment in Haridwar. 

The police stated that the court directed the police to file an FIR after complainant, Alok Vats had filed a petition in court that he was cheated. 

As per the case details, Vats was looking for a residential flat in 2013 and met Gyan Chandra Yadav, the director of M/s Emerald Tourist Homes Pvt Ltd, who promised to sell him a flat at an affordable rate.Yadav had said that his company is constructing villas, multi-storey residential buildings, flats and studio apartments by obtaining land from the Haridwar Industrial Development Authority of Uttarakhand. 

When he went to the site after seeing the advertisement, the staff assured him that there would be no issues while booking the apartment. In April 2013, he made a booking for a 550 sq ft space by paying Rs 1.48 lakhs. He was assured by the company director that he would also give a discount of 4 per cent and he paid a total of Rs 9.35 lakh in five instalments.

When the complainant again went to the sit, he learnt that there were reports that the builder had defaulted and the allotment of land had been cancelled due to non-deposit of the amount. The amount for the flats was deposited fraudulently without completing the documentary formalities. When he asked for my money back, the builder and other employees said that the amount would e paid soon but he didn't receive it. 

The police have registered and FIR under sections 420 (cheating), 406 (criminal breach of trust), 467, 486 and 471 (all three related to forgery), 323 (voluntarily causing hurt), 504 (intentional insult with intent to provoke breach of peace) and 120B (criminal conspiracy) of the Indian Penal Code.
